Drug Crimes

A veteran Florida criminal attorney can get you a favorable outcome

Arrests for drug crimes can result in major penalties. Even those cases that are reduced to lesser offenses still have lingering complications if you are arrested again in the future. Many people arrested for drug crimes in Florida are not aware that possession of certain medications without a prescription may be illegal. Often, those arrested are minors who have their futures threatened by an early drug charge.

Scott F. Kotler, P.A. works hard to get the drug charges of Miami-area residents reduced or dismissed. As a former prosecutor, I know all too well the long-term effects that a drug charge can have on your future, especially if you are arrested again on different charges. Speak with me about your case so you can get the protection you need from harsh drug laws.

Prescription drug abuse is increasingly common in Florida

Illicit prescription drug use is increasingly common.

The National Institute on Drug Abuse found that the most commonly misused substances were:

  • Pain relievers: Five million people annually abuse pain relievers such as oxycodone, codeine and morphine.
  • Tranquilizers: More than two million people use tranquilizers beyond their prescribed usage, including sleep medications such as Ambien.
  • Stimulants: One million people annually abuse prescription stimulants like Adderall or Ritalin.
  • Sedatives: Almost half a million people use sedatives like Seconal, Valium or Xanax without a prescription.

Other statistics showed that:

  • Roughly one in 12 high school seniors admitted nonprescription use of Vicodin.
  • About one in 20 also admitted abuse of Oxycontin.

Florida’s so-called “pill Mills” make the prevalence of medical-type drugs very common in the state. If you have been caught with prescription drugs or have a loved one in trouble for such substance, contact my law firm for more information regarding diversion programs and other alternative options to criminal punishment.

Florida has some of the nation’s heaviest drug crime sentences

Drug penalties in the Sunshine State can be quite severe. People arrested for simple possession of common drugs can face jail time, especially if they have prior offenses. Penalties for specific substance include:

  • Marijuana: Possession of marijuana under 20 grams is a first-degree misdemeanor that can be punished by up to one year in jail and a fine of $1,000.
  • Cocaine: Possession of cocaine under 28 grams is a third-degree felony in Florida, shich carries a maximum of five years of jail time and fine of $5,000. Your drivers license may also be suspended by the court for as long as two years.
  • Heroin: Like possession of cocaine, obtaining heroin in amounts that qualify as simple possession is a third-degree felony in Florida, punishable by as many as five years in jail, a $5,000 fine an a suspended drivers license for two years.

An experienced drug crime lawyer in Florida can apply a number of potential defenses to every charge. There are also diversion programs for those who qualify. Such programs can help someone overcome a drug habit and avoid prison time.

Scott is an excellent attorney!
I dont want to go too much into detail, but due to a misunderstanding I was facing serious child neglect charges. Mr. Kotler was able to explain my situation to the State Attorney who was able to dismiss the case. I really appreciate all his help. - a Criminal Defense client (5 star review)
